“Opinion that pays off – share your impressions and get a place to stay”

§1. GENERAL PROVISIONS

1. These regulations (hereinafter referred to as the “Regulations”) define the rules and conditions of participation in the competition “Opinion that pays off – share your impressions and win accommodation”.
2. The organizer and sponsor of the prizes in the Competition is RentPlanet Apartments Sp. z o.o. with its registered office in Wrocław, ul. Św. Mikołaja 7, REGON number: 366364260, NIP: 5223081618, entered into the register of entrepreneurs of the National Court Register under number 000065884.
3. The competition is ongoing and has no end date. Winners will be selected every three months from the start date of the competition. The organizer reserves the right to end or suspend the competition at any time, and will provide reasonable notice on the website and social media.
4. The prize in the Competition is a voucher for a stay of two consecutive nights in a selected apartment available on the website www.noclegi.rentplanet.pl.
5. A Participant in the Competition, hereinafter referred to as the “Participant”, may be a natural person who meets all of the following conditions: is an adult and has full legal capacity; completes the competition task described in the further part of the Rules (“Competition Rules”); used the Organizer’s accommodation services during the competition and expressed an opinion within that time frame; expresses a desire to participate in the Competition; is not an employee or a person cooperating on any other basis with the Organizer, nor is he or she a family member of such persons; family means a spouse, ascendants, descendants, relatives and persons in an adoption relationship; resides in the territory of the Republic of Poland.
6. Participation in the Competition is voluntary.
7. The Organizer declares that the Competition is not a game of chance, a raffle, a mutual bet, a promotional lottery, the outcome of which depends on chance, or any other form of game of chance provided for in the Act of 19 November 2009 on gambling (Journal of Laws of 2009, item 1540, as amended).
8. By registering to participate in the Competition, the Participant expresses his or her consent to the terms and conditions of the Competition set out in these Regulations.

§2. COMPETITION PARTICIPANTS

1. The Participant of the Competition, hereinafter referred to as the Participant, may be any adult natural person with full legal capacity who used the accommodation services of RentPlanet Apartments Sp. z o.o. during the competition and issued an opinion during that period.
2. Employees of the Organizer and other entities directly involved in the preparation and conduct of the Competition on behalf of the Organizer, as well as members of their immediate families up to the second degree, cannot participate in the Competition.
3. The provision of personal data by the Participant in terms of name, surname, e-mail address and telephone number is voluntary, but necessary to participate in the Competition and purchase the Prize.
4. Participation in the Competition involves the processing of personal data to the extent indicated in point 2.3 above. Personal data provided to the Organizer by the Participants of the Competition will be processed by it solely for the purpose of conducting the Competition, in particular (i) awarding prizes, (ii) delivering prizes, (iii) sending information related to the Competition under the terms and conditions specified in these Regulations.
5. The Participant has the possibility to view their personal data and to correct it and request its removal at any time. The administrator of the Participants’ personal data is the Organizer, in accordance with the Act of 29 August 1997 on the protection of personal data (consolidated text Journal of Laws of 2002 No. 101, item 926). The data will be stored at the Organizer’s headquarters.
6. Upon completion of the competition task, the Participant:

2.6.1 consents to the processing of his/her personal data by RentPlanet Apartments Sp. z o. o. for the purpose of participating in the competition “Opinion that pays off – share your impressions and win accommodation” and for marketing purposes.

2.6.2. grants the Organizer a transferable but non-exclusive license to use the content contained in a given competition entry without time limits, with the right to grant
sublicenses, in the following fields of exploitation: reproduction, recording, making a digital record, entering into computer memory; entering into own databases, either in original form or in the form of fragments; commercial and non-commercial use, including for commercial, advertising, promotional and marketing purposes; public display, reproduction; and also public disclosure in such a way that everyone can have access to it at a place and time chosen by the Organizer, in particular via the Internet or other computer networks,
2.6.3. grants consent to the publication of the Opinion under the terms of the license described above, including, at the Organizer’s discretion, without an author’s note including the first and last name,
2.6.4. is the author of the Opinion and that he/she has all property and non-property rights, in particular copyright to the Opinion that he/she posts, and is authorized to dispose of these rights without restrictions,
2.6.5. the submitted Opinion does not violate the rights of third parties and the provisions of generally applicable law,
2.6.6. has not granted any person a license to use the posted Opinion that would prevent the Opinion from being submitted to the Competition,
2.6.7. has the exclusive right to grant permissions to dispose of and use the posted Opinion.

§3. COMPETITION RULES

3.1. To participate in the Contest, you must post an opinion on the services provided by the Organizer on the selected website: Booking.com, Google.pl (RentPlanet S.A.) or Airbnb.pl, and then send it by email to marketing@rentplanet.pl with its content, the name of the website where it was posted and the number of the reservation made. The title of the email should be “an opinion that pays off”.

3.2. Opinions should be written in Polish.

3.3. The opinion should contain useful and true information about: the apartment, its location and amenities, as well as a subjective assessment of them.

3.4. The opinion should also:

3.4.1. be free of inappropriate content – expressions and sentences that may be considered offensive, promoting racism, hatred, containing threats, curses, statements with sexual overtones or other prohibited by applicable law

3.4.2. contain true information relating to the services provided by RentPanet Apartments Sp. Z o.o.
3.4.3. be useful to other travellers
3.4.4. be original and free of advertising content – it is forbidden to post texts copied from other websites, links, advertising content promoting other entities providing tourist services
3.4.5. not contain private information of third parties (names, addresses, telephone numbers, e-mail addresses, etc.)
3.4.6. not contain information on the price of the services provided
3.5. The opinions submitted must constitute reliable information on the services of RentPlanet Apartments Sp. Z o.o.
3.6. The Organiser reserves the right not to take into account the submitted opinions and to exclude the Participant from the Competition, in particular if the opinions are untrue, misleading, violating the rights of third parties or aimed at defaming the Organiser.
3.7. Contest entries submitted by Participants may not violate the rights of third parties, in particular copyrights, and may not violate generally applicable provisions of law. The opinion submitted by the Participant must be his/her own work and concern the service purchased by him/her. The Participant will not use all or parts of the statement to which anyone else holds the copyright.

3.8. The Contest will assess the interesting formula, substantive content and reliability of the opinion on the services provided by RentPlanet Apartments Sp. Z o.o.

3.9. The date of entry to the Contest is considered to be the date of sending the contest entry by e-mail to the Organizer.

3.10. The Contest is in no way sponsored, supported, administered or directly related to the Booking.com or Google.pl Service.

§4. PRIZES

4.1. Main Prize in the Competition – a voucher for a 2-night stay in an apartment of RentPlanet Apartments Sp. z o.o. for 2 people to be used from the date of awarding the prize until the end of the current year. The winner can choose one of the pool of available apartments available on the website www.noclegi.rentplanet.pl

4.2. The voucher may be subject to restrictions regarding the availability of dates, in particular during periods of high occupancy. Booking a stay using the voucher requires prior confirmation of the availability of the apartment.

4.3. The Organizer declares that the value of the prize provided for in the Competition does not exceed the amount of PLN 2,000, referred to in art. 21 sec. 1 item 68 of the Act of 26 July 1991 on personal income tax (Journal of Laws of 1993 No. 90, item 416, as amended), and therefore the value of the prize received by the winner of the Competition is exempt from personal income tax.
4.4. Prizes in the competition will be awarded every three months, counted from the date of its commencement, based on opinions submitted by participants during that three-month period. The Organizer will announce the results of the competition no later than 5 working days after the end of each three-month period, indicating the winners for that period. In the event of the competition ending, the Organizer undertakes to announce the last three-month period and the final prizes in advance.
4.5. The evaluation of the submitted opinions will be carried out by a three-person committee consisting of three representatives of the Organizer. Creativity, detailed descriptions, and adherence to the rules of correct Polish will be important in selecting the Winner.
4.6. The decision of the Competition Committee appointed by the Organizer is final and cannot be appealed.
4.7. The prize will be awarded to the person whose opinion is assessed by the Competition jury as the best among the remaining opinions.
4.8. The prize cannot be exchanged for cash.
4.9. The Jury will evaluate the competition entries no later than within 3 days of the end of the three-month period of the Competition.
4.10. Participants are not entitled to any remuneration for participating in the Competition or for the use by the Organizer of the content of the Opinion or its elements in any way, to any extent or time.
4.11. The Organizer reserves the right to verify the Participant’s compliance with the terms of the Regulations, and a negative result of verification or the Participant’s refusal to undergo verification means the loss of the right to further participation in the Competition or the prize.
4.12. The Winner of the Competition will be notified of the win by e-mail. After notification, the Winner will provide the Organizer with the necessary information (name, surname, e-mail address, telephone number) within 5 days of the Organizer sending the e-mail.
4.13. Failure to provide the above information is associated with the Winner’s waiver of the right to the Prize.
4.14. Only a person who meets the conditions included in the Regulations will be awarded the Prize in the Competition.
4.15. The Organizer shall not be liable for the impossibility of delivering the Prize, for reasons attributable to the Participant, in particular in the event of failure to provide or providing incorrect personal data by the Participant, a change in the Participant’s data of which the Organizer has not been informed or in the event of failure by the Participant to meet the conditions referred to in the Regulations. 4.16. The Prize will be sent to the Winner in electronic form to the e-mail address provided in the application.

§5. COMPLAINTS

5.1. Complaints regarding this Competition should be submitted in writing (by registered mail) to the postal address of the Organizer indicated in point 1.1 of the Regulations within 30 days of the date of the competition decision. 5.2. Complaints will be resolved within 14 days of the date of receipt of the complaint, and the person filing the complaint will be notified of the manner of its consideration in the manner indicated in the content of the complaint.

§6 FINAL PROVISIONS

6.1. The Competition is free for Participants.

6.2. The content of the Regulations is available at the Organizer’s office and on the website www.noclegi.rentplanet.pl

6.3. The provisions of these Regulations are subject to the provisions of Polish law, and the Organizer reserves the right to modify the rules of the Competition and extend the Duration of the Competition, provided that this does not violate the rights acquired by the Participants.

6.4. The Organizer reserves that it is not responsible for events that prevent the proper conduct of the Competition, which it was unable to predict or which it could not prevent, in particular in the event of random events, including force majeure.

6.5. The Regulations enter into force on the day of the commencement of the Competition.
